Communiqeh Communication Training Canada ("Communiqeh," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy outlines how we collect, use, and safeguard personal information in accordance with the privacy laws of Ontario and Quebec, including the Personal Information Protection and Electronic Documents Act ("PIPEDA") and Quebec’s Act respecting the protection of personal information in the private sector, as amended by the Act to modernize legislative provisions as regards the protection of personal information ("Law 25"). Our website and online booking platform are hosted on Wix, and our payment processing is handled through Stripe. This Privacy Policy operates in conjunction with the Communiqeh Terms of Service and Membership Community Code of Conduct.
Capitalized terms used in this Privacy Policy — including "Visitor," "Guest," "Member," "Participant," "Activity/Activities," "Products, Services, and Tools," and "Scheduled Event(s)" — have the meanings assigned to them in Section 2 ("Definitions") of the Communiqeh Terms of Service.
1. Relationship Between Documents
The Communiqeh Terms of Service, Privacy Policy, and Membership Community Code of Conduct together form the complete legal and ethical framework governing participation in Communiqeh Communication Training Canada's programs, community spaces, classes, sessions, and events. By using our website, attending a class, joining the community, or purchasing a membership, you confirm that you have read, understood, and agree to abide by all three documents.

2. Definitions
Throughout the Terms of Service, Privacy Policy, and Membership Community Code of Conduct :

"Visitor" refers to anyone browsing or accessing public areas of the Communiqeh website.

"Guest" refers to any registered user who creates a free account, subscribes to our mailing list, or accesses free resources but does not hold a paid membership plan.

"Member" refers to any individual or organization with an active paid membership plan granting full access to Communiqeh's community, live events, and member-only resources.

“Participant” refers to any individual or organization who registers for or schedules a Scheduled Event.

"Activity/Activities" collectively refer to any form of engagement with Communiqeh, including but not limited to accessing Communiqeh's website, and downloading, utilizing, participating in, or engaging with any Communiqeh free, fee-based, or subscription-based Product, Service or Tool.

"Products, Services, and Tools" collectively refers to, without limitation, language and communication training, professional learning services, digital products, and tools provided through Communiqeh's website, digital platforms (including but not limited to mobile and desktop applications, and cloud-based tools), and membership community.

"Scheduled Event(s)" refers to any Communiqeh engagement that requires reserving or scheduling a specific time, including but not limited to classes, sessions, and workshops.

"AI" or "AI model" refers to any third-party artificial intelligence tool, model, or platform (including but not limited to generative, conversational, and agentic AI, transcription, or analytics tools) that Communiqeh integrates with, references, creates build files for, or makes available through its Products, Services, and Tools.

We always collect the following personal information when you engage with our Products, Services, and Tools:

This data helps Communiqeh manage capacity, track engagement, and improve future programming.
4. How We Use Your Information
We use your information solely for the purpose of enhancing your experience with Communiqeh, including:

Scheduling and managing classes, sessions, and Scheduled Events

Using limited participation data (such as attendance or cancellations) to enforce community and event registration policies described in our Terms of Service and Code of Conduct

Communicating directly about Scheduled Events, and Products, Services, and Tools

Providing customer support

Improving our Products, Services, and Tools through analytics

Notifying you about new resources and promotions

Using recordings, transcripts, and AI-generated summaries for internal training, quality assurance, service improvement, and — with explicit consent — promotion
We will never use any information for a purpose inconsistent with the purpose for which it was collected.
5. Storage and Protection of Data
We store client information securely through Wix and Stripe, both of which comply with international security standards. Internally, access to client data is restricted to authorized personnel who require it to perform their duties. While we take all reasonable precautions, no online transmission is entirely secure, and we cannot guarantee absolute protection from unauthorized access.
6. Limitation of Liability
Communiqeh Communication Training Canada, its owners, instructors, subcontractors, and affiliates shall not be held liable for any loss, misuse, unauthorized access, disclosure, or alteration of personal information, except in cases of gross negligence or willful misconduct. We are not liable for any consequences arising from a Guest, Member, or Participant's unauthorized recording, transcribing, or capturing of a Communiqeh Activity in violation of this policy (see Section 9: “Video, Audio, and AI-Assisted Recording”). We are not liable for information that Visitors, Members, Guests, or Participants voluntarily share with other Visitors, Members, Guests, or Participants, or with third-party applications such as AI models. By using our Products, Services, and Tools, you accept responsibility for protecting your own credentials and personal data. This does not limit Communiqeh's own responsibilities under applicable privacy law for information Communiqeh itself may share with service providers acting on Communiqeh's behalf.
7. Cookies and Website Analytics
Our website uses cookies to improve user experience, analyze visitor behaviour, and provide functionality. Visitors can choose to decline non-essential cookies through the consent banner. We may also use third-party tools such as Google Analytics, AI-powered analytics tools, or similar platforms to analyze visitor behaviour and usage patterns; however, we do not control their data collection methods.
8. Communication and Marketing
We will only contact you regarding your Scheduled Events, Member Activity, or related Products, Services, and Tools. Promotional emails or marketing communications are sent only with your explicit consent, which can be withdrawn at any time. Communiqeh complies with Canada’s Anti-Spam Legislation (CASL).
9. Sharing of Information
We do not sell, trade, or rent personal information. Data may be shared only with authorized service providers, teachers, and the third-party platforms used to deliver Communiqeh’s Products, Services, and Tools, as necessary to operate our Products, Services, and Tools. Communiqeh does not control, and is not responsible for, the data-handling practices of any third-party platform — see Section 10 (“AI and Personal Information”) below and Section 14 (“Third-Party Tools and Platforms”) of our Terms of Service. We strongly advise those engaging in Communiqeh Activities not to share personal information (such as addresses, passwords, or payment details) with other individuals. Communiqeh cannot control the actions of individuals and is not liable for any personal information shared between users.
10. Video, Audio, and AI-Assisted Recording
Communiqeh may record its Activities (such as live events, sessions, group classes), and may use AI-enabled meeting or virtual-conferencing tools to record, transcribe, summarize, or analyze these sessions, for learning, quality assurance, service improvement, and internal purposes. By attending any Communiqeh-hosted Activity, you consent to being recorded, transcribed, or analyzed by these tools for the internal purposes described above.
Communiqeh will always obtain your explicit consent before using any material that could identify a Guest, Member, or or Participant in external promotional or marketing materials.
Private 1:1 sessions may be recorded, transcribed, or analyzed by AI tools only with the Participant’s consent.
Recordings, transcripts, and AI-generated summaries remain the intellectual property of Communiqeh and may not be shared externally by Guests, Members or Participants.
Participants are strictly prohibited from independently recording, transcribing, or otherwise capturing any Communiqeh Activity using their own tools or devices. This rule is reinforced in the Communiqeh Terms of Service and Code of Conduct. Violations of this rule may result in legal action.
11. AI and Personal Information
Some of Communiqeh’s AI build files, AI Guides, and set-up instructions include optional fields or prompts where you may choose to enter information to customize your experience with a third-party AI model. Entering this information is never required: these fields exist solely to help you personalize the tool’s output.
Communiqeh does not have the ability to collect, receive, view, or store any information you choose to enter into a third-party AI model, whether or not it relates to you personally.
Communiqeh never recommends entering sensitive information — including but not limited to passwords, banking or financial details, home addresses, government identification numbers, or other specifically identifying information — into any AI model or build file field, and Communiqeh never includes such information about any individual in the tools we provide.
If you choose to enter personal or sensitive information into a build file, custom instruction set, or any third-party AI model in connection with your use of Communiqeh’s Products, Services, and Tools, you do so entirely at your own discretion and risk. You acknowledge and agree that Communiqeh is not responsible or liable for any privacy breach, security incident, data loss, misuse, or unauthorized disclosure arising from information you choose to share with a third-party AI model or platform.
12. Minors, Privacy, and Parental Responsibility
Access to any Communiqeh Activity or Communiqeh Products, Services, and Tools — is governed by the age requirements in Section 4 of the Terms of Service (18+ generally; 15–17 with parental consent; under 15 only with active parental supervision). Where a minor participates in any Communiqeh Activity or utilizes any Communiqeh Product, Service, or Tool or utilizes third-party applications or files for third party applications made available through Communiqeh, with parental consent or supervision, responsibility for any personal information the minor chooses to share — whether with Communiqeh, with other Visitors, Members, Guests, or Participants, with an AI model, or with any other third-party application — rests with the minor's parent or legal guardian, not with Communiqeh. Communiqeh has no reliable means of verifying a user's age or the accuracy of any age representation made at registration or at any point of use, and is not responsible for a minor's misrepresentation of their age or for any consequence arising from such misrepresentation.
13. Automated Decision-Making
If any AI-enabled Product, Service, or Tool is used to render a decision about you based solely on automated processing (for example, a language-proficiency evaluation), you have the right to be informed of this, to request the reasons for the decision, and to request that the decision be reviewed by a person, consistent with Quebec’s Law 25 and other applicable privacy law.
Your relationship with, and any data you share with, a third-party AI provider is governed solely by that provider’s own terms and privacy practices, which we encourage you to review independently.
14. Your Rights and Choices
You have the right to access, correct, or delete your personal data, withdraw consent for communications, and inquire how your data is stored or used. Requests should be directed to info@communiqeh.ca. We will respond within a reasonable timeframe in accordance with applicable privacy laws.
Please note that Communiqeh’s systems, including account records, are hosted on Wix. Deleting your account is permanent: once your account and associated data are deleted, this information is permanently removed and cannot be recovered by Communiqeh or by you. This includes private class records, certifications, and access to the Communiqeh Community.
15. Updates to Privacy Policy
We reserve the right to update our Privacy Policy as needed to comply with legal requirements or to reflect changes in our practices.
16. Governing Law and Jurisdiction
This Privacy Policy, and any dispute arising from or relating to it, is governed by the privacy laws of the Province of Ontario, the applicable federal laws of Canada (including PIPEDA), and, where applicable, the laws of the Province of Quebec (including Law 25).
If you are a consumer resident in Quebec, or in any other jurisdiction where applicable law grants you privacy or consumer protections that cannot be waived by agreement — including, without limitation, rights relating to explicit consent for sensitive personal information or rights related to automated decision-making — this section does not apply to you to the extent it conflicts with those mandatory protections, and your rights under the law of your province, territory, or country of residence continue to apply. Where Law 25 and this Privacy Policy differ, Communiqeh will apply whichever standard provides Quebec residents with the greater protection.
17. Acknowledgement and Agreement
By accessing the Communiqeh website, registering as a Guest, or becoming a Member, or participating in any Communiqeh Activity, you acknowledge that you have read, understood, and agree to abide by the Communiqeh Terms of Service, Privacy Policy, and Code of Conduct.
