Communiqeh Communication Training Canada ("Communiqeh," "we," "us," or "our") provides Products, Services, and Tools through its website, digital platforms (including but not limited to mobile and desktop applications, and cloud-based tools), and membership community (collectively referred to as the "Communiqeh Community"). These Terms of Service ("Terms") govern your use of the Communiqeh Community and any Products, Services, and Tools. By engaging in any Activity, you agree to be bound by these Terms.
1. Relationship Between Documents
The Communiqeh Terms of Service, Privacy Policy, and Membership Community Code of Conduct together form the complete legal and ethical framework governing participation in Communiqeh Communication Training Canada's programs, community spaces, classes, sessions, and events. By using our website, attending a class, joining the community, or purchasing a membership, you confirm that you have read, understood, and agree to abide by all three documents.

2. Definitions
Throughout these Terms of Service:

"Visitor" refers to anyone browsing or accessing public areas of the Communiqeh website.

"Guest" refers to any registered user who creates a free account, subscribes to our mailing list, or accesses free resources but does not hold a paid membership plan.

"Member" refers to any individual or organization with an active paid membership plan granting full access to Communiqeh's community, live events, and member-only resources.

“Participant” refers to any individual or organization who registers for or schedules a Scheduled Event.

"Activity/Activities" collectively refer to any form of engagement with Communiqeh, including but not limited to accessing Communiqeh's website, and downloading, utilizing, participating in, or engaging with any Communiqeh free, fee-based, or subscription-based Product, Service, or Tool.

"Products, Services, and Tools" collectively refers to, without limitation, language and communication training, professional learning services, digital products, and tools provided through Communiqeh's website, digital platforms (including but not limited to mobile and desktop applications, and cloud-based tools), and membership community.

"Scheduled Event(s)" refers to any Communiqeh engagement that requires reserving or scheduling a specific time, including but not limited to classes, sessions, and workshops.

"AI" or "AI model" refers to any third-party artificial intelligence tool, model, or platform (including but not limited to generative, conversational, and agentic AI, transcription, or analytics tools) that Communiqeh integrates with, references, offers build files/instructions for, or makes available through its Products, Services, and Tools.
3. Language, Translation, and Client Responsibility
While Communiqeh strives to provide clear communication, including translations when possible, the official language of these Terms is English. Translations are provided for convenience only. In the event of a discrepancy, the English version prevails. It is the user's responsibility to ensure full understanding of these Terms, the Privacy Policy, and the Code of Conduct before participating.
4. Requirements for Website and Service Use
To engage in any Activity, you must be at least 18 years old or the legal age of majority in your jurisdiction and possess the authority to enter into these Terms. Minors aged 15–17 may participate with parental consent; minors under 15 may only participate under active parental supervision. This applies equally to access of any AI build files, user guides, or set-up guides made available through the Communiqeh Community.
5. Code of Conduct and Misconduct Policy
All participants are expected to behave respectfully and professionally in accordance with the Communiqeh Membership Community – Code of Conduct. This Code outlines behavioural expectations, privacy responsibilities, and enforcement procedures. The Code also applies to behaviour during Scheduled Events. Violation of the Code of Conduct or these Terms may result in suspension or termination of access without refund. 6. Social Media, Contests, and User Content
Communiqeh may operate social media accounts and may, from time to time, run contests or promotions, which will be governed by their own specific rules provided at the time. Communiqeh may photograph or record events, classes, and sessions for use in marketing, social media, and promotional materials, including testimonials. Communiqeh will always request your permission before publicly posting any photo or video in which you are specifically identifiable. By participating in Communiqeh live engagements you consent to incidental, non-identifying reproduction, photography or recording for these purposes.
7. Scheduled Events: Scheduling, Rescheduling, Cancellations, Notice and Refunds
Scheduling, rescheduling, and cancellation of Scheduled Events must be managed through the online booking system and are the sole responsibility of the Participant. Participants must make changes at least 48 hours before the scheduled start time of the Scheduled Event. If a participant cannot access Communiqeh’s booking site to make changes or experiences difficulties when attempting to access a Scheduled Event, it is their responsibility to notify Communiqeh immediately. Missed Scheduled Events caused by failure to reschedule or cancel within the specified period or unreported access difficulties will not be refunded or rescheduled.
All sales of Scheduled Events are final, and refunds are provided only in accordance with Communiqeh's refund policy.
8. Class Packages: Scheduling, Expiry and Refunds
All class packages expire one (1) year after purchase. Communiqeh does not offer refunds for unused and expired classes. Any extension of class packages beyond one year is at the sole discretion of Communiqeh.
All sales of class packages are final, and refunds are provided only in accordance with Communiqeh's refund policy.
9. Membership: Billing, Auto-Renewal, Expiries, and Cancellations
Automatic Renewals
All Communiqeh memberships renew automatically on the same calendar date each billing cycle (monthly or annual) based on the original subscription date. By completing your purchase, you authorize Communiqeh Communication Training Canada ("Communiqeh") to charge your stored payment method for each renewal period until you cancel.
Payment Information
Payment details are securely stored by our payment processor (Stripe) for the purpose of processing subscription renewals. Communiqeh does not store full credit card information on its servers.
Cancellations
You may cancel your subscription at any time through your Communiqeh account. To avoid being charged for the next billing cycle, cancellation must be completed at least 24 hours before the next scheduled renewal date. Payments already processed are non-refundable, and access continues until the end of the paid period.
Free Trials
Free trials automatically convert to a paid membership at the end of the trial period unless cancelled before the trial expiry date. The payment method provided at registration will be charged on the trial's end date. You can cancel any time during the trial period through your account to avoid being charged.
Refunds
All membership fees are non-refundable once processed. We do not offer prorated refunds for partial months or unused time or unused membership features. Cancellations made after a renewal payment for membership fees has been processed will take effect at the end of the current billing cycle.
10. Privacy Policy
Your use of Communiqeh services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information. By agreeing to these Terms, you confirm that you have read and accepted the Privacy Policy. Behavioural expectations related to privacy are further outlined in the Membership Community Code of Conduct. The full Privacy Policy is available at https://www.communiqeh.ca/privacypolicy.
11. Refund Policy
All sales of Communiqeh Products, Services, and Tools and Scheduled Events are final and refunds will not be issued.
12. Limitation of Liability
Communiqeh Communication Training Canada, its owners, instructors, subcontractors, and affiliates are not liable for any indirect, incidental, or consequential damages arising from any Activity or information sharing, except in cases of gross negligence or willful misconduct. You agree to take responsibility for your own conduct and interactions and to hold Communiqeh harmless for the actions of others.
13. AI and Personal Information
Some of Communiqeh's build files and set-up instructions include optional fields or prompts where you may choose to enter information to customize your experience with a third-party AI model. Entering this information is never required: these fields exist solely to help you personalize the tool's output. Communiqeh does not have the ability to collect, receive, view, or store any information you choose to enter into a third-party AI model, whether or not it relates to you personally.
Communiqeh does not recommend entering sensitive information — including but not limited to passwords, banking or financial details, home addresses, government identification numbers, or other specifically identifying information — into any AI model or build file field, and Communiqeh never includes such information about any individual in the tools we provide.
If you choose to enter personal or sensitive information into a build file, custom instruction set, or any third-party AI model in connection with your use of Communiqeh's Products, Services, and Tools, you do so entirely at your own discretion and risk. You acknowledge and agree that Communiqeh is not responsible or liable for any privacy breach, security incident, data loss, misuse, or unauthorized disclosure arising from information you choose to share with a third-party AI model or platform. Your relationship with, and any data you share with, third-party AI providers is governed solely by that provider's own terms and privacy practices, which we encourage you to review independently.
14. Third-Party Tools and Platforms
Communiqeh's Products, Services, and Tools may reference, integrate with, or direct you to third-party tools and platforms (including but not limited to AI models, payment processors, and scheduling software). Communiqeh does not control and is not responsible for the availability, performance, security, or practices of any third-party platform. Your use of any third-party tool is subject to that provider's own terms of service and policies, and any disputes, losses, or issues arising from your use of a third-party platform are between you and that provider.
15. Intellectual Property
All content provided by Communiqeh — including but not limited to build files, guides, instructional materials, templates, course content, and website content — is the property of Communiqeh Communication Training Canada and is protected by copyright and other intellectual property laws. Access to this content, whether free or as part of a paid membership, grants you a limited, non-exclusive, non-transferable licence for your own personal or internal use only. You may not copy, reproduce, alter, distribute, resell, sublicense, or publicly share Communiqeh's content without prior written permission.
16. Governing Law and Jurisdiction
These Terms, and any dispute arising from or relating to them or your use of Communiqeh's Products, Services, and Tools, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
If you are a consumer resident in Quebec, or in any other jurisdiction where applicable law grants you consumer protections that cannot be waived by agreement, this section does not apply to you to the extent it conflicts with those mandatory protections, and your rights under the law of your province, territory, or country of residence continue to apply.
17. Dispute Resolution
If a dispute arises between you and Communiqeh, both parties agree to first attempt to resolve the matter informally by contacting Communiqeh directly. Communiqeh can be contacted directly at info@communiqeh.ca. If the dispute cannot be resolved informally within a reasonable period, either party may pursue resolution through mediation or, where mediation is unsuccessful or inapplicable, through the courts of Ontario as set out in Section 14.
18. Severability
If any provision of these Terms is found by a court or tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
19. Acknowledgement and Agreement
By engaging in any Activity, you confirm that you have read, understand, and agree to be bound by the Communiqeh Terms of Service, Privacy Policy, and Membership Community Code of Conduct. These three documents operate together and collectively govern your engagement with all Communiqeh Products, Services, and Tools.
We reserve the right to update these Terms of Service as needed to comply with legal requirements or to reflect changes in our practices.
