Communiqeh Language Training Canada (“Communiqeh,” “we,” “us,” or “our”) provides language training, communication development, and professional learning services through its website, digital platforms, and membership community (collectively referred to as the “Communiqeh Community”). These Terms of Service (“Terms”) govern your use of our services and website. By accessing, purchasing, or participating in any Communiqeh service, you agree to be bound by these Terms.
1. Relationship Between Documents
The Communiqeh Terms of Service, Privacy Policy, and Code of Conduct together form the complete legal and ethical framework governing participation in Communiqeh Language Training Canada’s programs, community spaces, private classes or coaching sessions, and events. By using our website, attending a class, joining the community, or purchasing a membership, you confirm that you have read, understood, and agree to abide by all three documents. The most recent versions are available in the footer section of www.communiqeh.ca.
2. Definitions
Throughout these Terms:

“Visitor” refers to anyone browsing or accessing public areas of the Communiqeh website.

“Guest” refers to any registered user who creates a free account, subscribes to our mailing list, or accesses free resources but does not hold a paid membership plan.

“Member” refers to any individual or organization with an active paid membership plan granting full access to Communiqeh’s community, live events, and member-only resources.

“Activities” collectively refer to private classes or coaching sessions, and events.
3. Language, Translation, and Client Responsibility
While Communiqeh strives to provide clear communication, including translations when possible, the official language of these Terms is English. Translations are provided for convenience only. In the event of a discrepancy, the English version prevails. It is the user’s responsibility to ensure full understanding of these Terms, the Privacy Policy, and the Code of Conduct before participating.
4. Age Requirements, Consent, and Liability
Members of the Communiqeh Community must be 18 years of age or older.
Communiqeh may offer certain programs and activities that are suitable for minors under 18 years of age. Participation is subject to the following conditions:

Ages 15–17: May participate independently with the express written consent of a parent or legal guardian.

Under 15: May only participate with the active supervision of a parent or legal guardian.
All purchases, account management, and communications involving minors under 15 must be completed by the parent or guardian. By accessing our services, minors represent and warrant that they have obtained parental or guardian consent. Communiqeh does not verify age or consent and assumes no liability if a minor misrepresents their age or accesses services without authorization. Parents or guardians remain fully responsible for all actions, purchases, and participation of any minor using Communiqeh services.
5. Attendance and Event Participation
Communiqeh values accountability, reliability, and mutual respect. The following attendance policies apply to both community events and private classes or coaching sessions.
a) Communiqeh Community Event Participation and Attendance
As a professional development Community, we value accountability and respect. We ask that Members honour their attendance and registration commitments. If you register for an event and do not cancel within the cancellation window, it prevents other Members from participating.
Members must cancel at least 24 hours before the event start time. Cancellations can be done through the Community portal.
Non-compliance progression:

1st missed event: friendly reminder.

2nd missed event: reminder plus warning.

3rd missed event: Member enters a 30‑day “cool‑down period” during which they cannot register for community events.
Canceling and resubscribing a membership does not reset the cool‑down period.
b) Private Class/Session Attendance
Private classes or coaching sessions must be cancelled or rescheduled at least 48 hours before the scheduled start time. Teachers and coaches will wait up to 10 minutes for the Member to arrive. The Member will receive a reminder from the teacher or coach. After that, if the Member has not arrived to the class/session, it will be marked as completed.. Managing class scheduling, rescheduling, or cancellations within the 48‑hour window is the Member’s responsibility.
Classes or sessions not cancelled or rescheduled within the 48‑hour window, or where the Member does not attend, are considered completed and will not be credited back to the Member’s account.
If a private class or coaching session is cancelled by the teacher or coach, the session will be credited back to the Member’s account.
6. Private Class Access and Expiration Policy (All-Access Premium Membership)
Members with an All-Access Premium Membership receive eight (8) private classes or coaching sessions per monthly billing cycle. Members must maintain an active Communiqeh Membership to book and attend private classes or coaching sessions. Unused classes or sessions accumulate and are valid for up to twelve (12) months from the date they are issued and then automatically expire.
If a membership is reactivated within that twelve-month period, the Member may use any accumulated classes or sessions while their membership remains active. Expired classes or sessions are non-refundable, hold no cash value, and cannot be reinstated once expired.
Communiqeh may send reminders to help Members schedule their classes or sessions, but such reminders are courtesy communications only and not guaranteed.
7. Refund Policy
All membership fees and class payments are final and non-refundable.
It is the Member’s responsibility to manage their membership, including cancellations, renewals, and participation.

Communiqeh may, at its sole discretion, issue class or session credits in specific cases as described in the Attendance and Event Participation section of these Terms.
8. Code of Conduct and Misconduct Policy
All participants are expected to behave respectfully and professionally in accordance with Communiqeh’s Code of Conduct. The Code also applies to behaviour during private classes or coaching sessions. Violation of this Code or these Terms may result in suspension or termination of access without refund.

Communiqeh reserves the right, at its sole discretion, to determine what constitutes harmful, disruptive, or inappropriate behaviour within the Community, during private classes or coaching sessions, or in any Communiqeh-related interaction. Such behaviour may result in temporary suspension or permanent removal, even if not specifically identified in these Terms or the Code of Conduct.
9. Recordings, Likeness, and Privacy
Communiqeh may record live classes, coaching sessions, and community events for training, quality assurance, or internal review purposes. By attending or participating, you consent to being recorded and understand that such recordings may be viewed by others inside or outside the Community for legitimate business purposes.
Recordings remain the intellectual property of Communiqeh and may not be reproduced or shared externally.
Communiqeh will always request explicit permission from any identifiable participant before using their likeness, voice, or image in external promotional or marketing materials.

10. Account Deletion
If a Member deletes their Communiqeh account, all data associated with that account—including private classes or coaching sessions, achievements, certifications, and other items—will be permanently deleted. Communiqeh is not responsible for the loss of any data or unused classes/sessions resulting from voluntary account deletion.
10. Limitation of Liability
To the maximum extent permitted by law, Communiqeh Language Training Canada and its owners, instructors, and affiliates shall not be liable for indirect, incidental, or consequential damages arising from your participation or use of services, except in cases of gross negligence or willful misconduct. By participating, you agree to take personal responsibility for your conduct and to hold Communiqeh harmless for the conduct of others.
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be brought exclusively before the courts located in the Niagara Region, Ontario.
12. Right to Update Terms of Service
Communiqeh reserves the right to update these Terms of Service at any time. Any updates will be communicated through the website or by notice to Members and Guests.
13. Acknowledgement and Agreement
By accessing the Communiqeh website, registering as a Guest, or becoming a Member, you confirm that you have read, understood, and agree to be bound by the Communiqeh Terms of Service, Privacy Policy, and Membership Community Code of Conduct. These three documents operate together and collectively govern your participation in all Communiqeh programs, private classes or coaching sessions, and community spaces.
